Ryan, Ryan & Viglione attorney Michael Viglione recently obtained a $300,000.00 personal injury award for a Lake County pedestrian that was struck by an automobile. The award, which was reduced to $225,000.00 based upon the pedestrian’s comparative fault in causing the incident, was made by a three person Underinsured Motorist arbitration panel.
The pedestrian suffered injuries to the left side of his body, including his shoulder, knee, and back/neck. Viglione used expert testimony from the client’s orthopedic surgeon to substantiate that multiple future surgeries were necessary to lessen the degree of pain and suffering which this 65 year old individual was reasonably certain to experience throughout the remainder of his life.
The gross award amounted to nearly 12 times the pedestrian’s past medical expenses, and was 30 times more than the UIM insurer offered by way of settlement. Additionally, the award was obtained despite the insurer utilizing a board-certified orthopedic surgeon expert to dispute the pedestrian was injured in any manner.
